PROMISSORY NOTE $68,151.50 Northampton, Massachusetts October 1, 2001 For value received, we, BOYSEN HODGSON and JESSAMYN SMYTH, jointly and severally, of 69 Boyle Road, Gill, Massachusetts, promise to pay to GEORGE SALZMAN, of 12-14 Laurel Street, Cambridge, Massachusetts 02139, the principal sum of SIXTY-EIGHT THOUSAND ONE HUNDRED FIFTY-ONE and 50/100 DOLLARS ($68,151.50), with interest on the unpaid principal balance at the rate of five per cent (5.00%) per annum, payable over a term of twenty (20) years in consecutive monthly installments of Four Hundred Forty-nine and 77/100 Dollars ($449.77) commencing one month from date and on the same day of each month thereafter, which payments shall first be applied to interest then due and the balance thereof remaining applied to principal. The makers and endorsers waive presentment, notice and protest, and agree that the holder shall have the right to grant any indulgences or forbearances without in any way affecting the personal liability of the makers or endorsers. In the event that this note shall be placed in the hands of an attorney for collection after default, then reasonable attorney’s fees shall be due and payable, in addition to the aforesaid principal and interest. If default be made in the payment of any installments under this note and the default is not made good prior to the due date of the next installment, the unpaid balance of the principal sum and accrued interest shall at once become due and payable without notice at the option of the holder of this note. If the ownership of the premises mortgaged as security for this note, or any part of said premises, shall become vested in any person other than the makers of this note, then the principal sum and accrued interest shall at once become due and payable. This note may be prepaid without penalty at any time. If default be made in the performance of any condition of the mortgage securing this note, the unpaid balance of the principal sum and accrued interest shall at once become due and payable upon thirty (30) days written notice to the makers at the option of the holder of this note. This note is secured by a first mortgage on real estate known as 69 Boyle Road, Gill, Franklin County, Massachusetts.
